Simpluris, Inc. (“Simpluris”) values our customers greatly and is dedicated to protecting them and their information and assets through various methods including our policies around data and privacy. This Privacy Policy describes how Simpluris may use and disclose personal information that we may collect through normal business operations including legal proceedings and projects as directed by court order, client direction, or other legal compliance where we may be required to receive such information directly or collect information as part of the case process.
What data do we collect?
Simpluris may collect personal information through various methods including but not limited to direct receipt of data from clients; directly from class members via website, email, fax, text message, physical mail, and phone; or any other method deemed necessary in relation to the execution of contracted duties as required by court order, legal proceeding, or client direction. Any information received is only used for the express purpose of administering the case or project such as verification of case involvement, claim validation, tax verification, and/or class settlement classification or calculations. Information collected or received may include name, address, phone number, email, tax identification number (i.e. SSN, TIN, EIN), and/or other case related class information (i.e. dates of employment, companies worked for, etc.). Additionally, Simpluris may be employed to or required to gather information from third party sources to fulfill its administration duties, comply with court orders or client direction, and/or comply with various legal or tax compliance requirements.

Simpluris typically receives data directly from the court, client, or defendant; or, collects data directly from the class member/claimant through normal case activities such as claim or opt out submission, contact center interaction, or website access. Simpluris may also receive data from third party providers in direct relation to case activity as required by court order, settlement agreement, or client direction.

We may share information as needed to fulfill case proceedings, legal duties, compliance, class member requests, process your claim or otherwise provide our noticing and/or administration services. For example, we may be called upon to provide information to the court in which a case is pending, the litigants in the case and their counsel. We may also disclose information to the extent necessary or appropriate to government agencies, advisors, and other third parties in order to comply with applicable laws, the service of legal process, or if we reasonably believe that such action is necessary to (a)comply with the law requiring such disclosure; (b) protect the rights or property of Simpluris or its affiliated companies; (c) prevent a crime or protect national security or (d) protect the personal safety of the users or the public. We do not sell or rent any information provided to us.
Protection of Social Security Numbers and Other Non-Public Personally-Identifiable Information
As part of Simpluris’ claims administration process, Simpluris collects non-public personally-identifiable information such as social security numbers. Simpluris understands the importance, and is committed to, protecting the security of such information. Our personnel are required to follow specific security procedures for storing, using, and disposing of non-public personally-identifiable information provided to us. We may grant access to such information only to individuals who reasonably need it to accomplish the purposes for which the information was collected. Simpluris policy prohibits the unlawful disclosure of Social Security numbers or other non-public personally-identifiable information.

Options
If you do not wish to submit or disclose your personal information to Simpluris, you may do so at your discretion. Please note, if you choose to not submit your information to Simpluris, you may not be able to proceed or participate with the administration of the related legal proceeding and thus may be excluded from the settlement disbursement, compensation, or other benefits.

  • Personal Information Categories – In the past 12 months, the following categories of personal information have been collected in relation to the administration of cases or projects Simpluris handles through either receipt of information from data owners or directly from the class member/claimant through the lifecycle of the case: identifying information (i.e. name, SSN) contact information (i.e. address, phone, email), project related classification information, or internet/network data (i.e. IP address, website activity).
  • Personal Information Sources – Simpluris has collected personal information through sources described above in the Personal Information Categories.
  • Purposes of Collection– To execute and administer case/project as directed by court order, settlement agreement, or client direction, fulfill class member/claimant request, comply with all applicable laws and regulations, fraud detection/prevention, or performance monitoring.
  • Simpluris does not sell, share, rent, or trade personal information with third parties. In the past 12 months, Simpluris has disclosed personal information to the following categories in relation to the execution of cases/projects as directed by court order or client requirement: tax agencies/authorities, courts, clients, service providers, and authorized third parties.
